Guys .. help

BToth has brought to my attention that a handicapping website (I won't post here in the public who) .. has been stealing my picks the past two weeks or so. He says that they have had all the same picks as me, except for the two days I took off, when he obviously had different picks. They also lost those picks, though he's been winning most of mine. lol.

Is there anything I can do in this case? They are charging my picks to clients basically and claiming they are theirs. Is this fraud or is this allowed?

Im no lawyer but im guessing they would say coincidence , or prove it. Obviously you know and many here would know but its the proving it where it gets tricky , good luck PV

okay well i'll post what he messaged me for you guys to look at.. maybe expose them, or they'll get whats coming to them .. either way I haven't been to this guys website, n'or do I care too.

Since January 27th, American Sports Consultants (http://www.americansportsconsultants.com/index.php) has had 14 of the same (or very similar) 17 plays as you from January 27th . And 2 of those 3 plays that did not match were when you did not post it on Sunday January 31st. Just thought I let you and handle it the way want to as they are selling these plays to clients.

I do not know how much drama you want in your thread, but I will post something there, too. I appreciate all of the hard work you have been doing.

Sucks tremendously man... I wish there was some better news for you but unfortunately there is next to nothing you can do. By posting "picks" on a public forum you have offered them to the public. And they are just picks which would not follow under any type of protection. Now your written analysis, if you write one, is another story. That literature has been created by you, owner, and could be copywrited and very easily proven that you created it as someone would have to copy it verbatim to fall under any protection under federal law.<?xml:namespace prefix = o ns = "urn:schemas-microsoft-comfficeffice" /><o></o>

Now the tricky part, because we use the internet, it would be federal. Have you ever priced a federal attorney? LOL, it's a great job to have, trust me. The court process would take from 12-18 months in court. Plus there are monetary limits and threshold that have to be crossed in order to even file under federal jurisdiction. Then you would have to PROVE there was a monetary damage of X dollars and then the specific damaged was gained by taking something that was legally yours to begin with.<o></o>

Its a tough spot, which is why it runs so rampant. All in all there is not much you can do, which sucks because I follow you and your good! And scandalous thieves should be treated much like they used to in biblical times...<o></o>

what you should do is post a play with the wrong line or vs a wrong team....scamdicappers are so dumb they probably won't catch on. Esp if you do a Colorado St. instead of Colorado.

just one more proof scamdicappers will do anything to win..that sucks.

Very nice move by Mr. Wilheim. Unfortunately, I am pretty sure this is all you can do: call them out on it, and possibly try to embarrass them or make them stop.

I am far from a lawyer, but I don't believe you can "own" a pick on a sports team, especially when that pick is posted on a public forum. Completely different situation here, but a few years ago, I remember the Associated Press going nots on various web sites who were re-posting its box scores. The AP was told there was nothing they could do about it: "You don't own stats." Similarly, I don't believe you can "own" picks....lots of people are making picks on the same team (or teams), no different than lots of people are writing down stats of a game.

Now that I've taken the time to write out this post, let's take a moment or two to laugh at how stupid I am. Clearly I have no expertise on this matter.
